Dear Judge Mendiguren,
I have been informed by a member of your church that after reviewing the recent Freedom of Information Act
requests made by my daughter Stephanie you have decided to initiate an investigation into the fraud committed by
the Child Welfare Services and their refusal to comply with the requests that she has made. I’m sure that the
realization that these heinous acts occurred under your authority and in your Court has been devastating to you as
a person of integrity and a man of conscience. Your epiphany has not come in time to prevent the years of
exploitation and abuse, the sexual assault, or the near death of my daughter but will certainly help her to begin
healing emotionally. I applaud the personal risk and the courage that it took for you to return and expose the
criminal element and the reprehensible behavior that permeates this organization responsible for protecting our
most vulnerable population, our children.

Here are the portions of the Freedom of Information Act Request and correspondence between myself and child

1.) The 147A (dated February 30th, 2000) page 7 and the 147B page (dated August 18th 2000, not
included) make the following statement “Mr. Bares daughter and Monica Lopez both have made reference to at
least two incidents in which Mr. Bare was involved in violence; military records have not been requested and
documentation to prove or disprove this information has not been accessed.” (Click Here) I was 20 months old
when my mother left Germany and my father took full custody of me. I was 3 years old when he was honorably
discharged from the U.S. Army. The only incident I am aware of is one in which he was assaulted and stabbed
while performing his official duties as a non-commissioned officer. I did not report my father as violent and am
outraged that this was attributed to me. It is no coincidence that my caseworker is an incest survivor, or that her
father was career military. I would also like to note that the statement quoted above is eerily similar to the following
statement “Inasmuch as past behavior is the predictor of future behavior a better understand of Mr. Bare’s history
of violence in other settings is recommended. It may be helpful to gain access to his military record or have
discussions with his exwife and family to ascertain if there has been a pattern of violence in the past.” This
statement can be found on page 7 of my father’s psychological evaluation (dated March 5th, 2000) (Click Here).
It is noted in the evaluation and in the Citizens Review Board report (dated June 19th, 2000 page 3) that SCF had
reported no history of violence. (Click Here) The CRB also found (page 4) that SCF is in violation of ORS
419.780(2) for failing to provide the CRB with the 147A as required law. (Click Here) It would appear that Ms.
Brookbank used the evaluation dated March 5th to tailor the lie about me reporting my father as violent in the
military in the 147A dated February 30th. In addition, there is another reference in the 147A to a letter dated
March 13th, the 147A was not provided to the CRB as required by law, and as you can see by the date stamp it
was not received by my father’s attorney until June 8th. Yet the date on the 147A is handwritten only on the cover
page and the signature page and both Jean Brookbank and her supervisor Jerry Buzzard date the document with
the unusual and nonexistent date February 30th. (Click Here) All of this would seem to indicate that this
document was prepared in June and that they conspired to falsify this document.

to locate further documentation in the case record that pertains to this statement. There are no further records
responsive to this request. As such I am also unable to provide the explanation you request as to how the
information was offered to the court, but not entered into the record.

I have received the agencies response to my freedom of information act request and am asking you and your
supervisor to explain in writing why, with the exception of providing me with the 147A assessment form, my
request(s) were not addressed. Specifically I am demanding that item #1 be addressed immediately and I have
provided you with a copy of the original FOIA request with the question and supporting statement highlighted. If
you are denying me the documentation supporting the statement by our caseworker Jean Brookbank that I
reported my father as violent at least twice, then (as was requested initially) please provide the exemption you are
citing in your response. If the documentation is absent or missing from the record then please clearly state which,
and provide me with a timeline and detailed explanation regarding how the information was offered to the court
but not entered into the record.
I would like to make two things perfectly clear to you;
As the request states, I did not report my father as violent and having read the documents available to me it is
clear that he was compelled by your agency to undergo a psychological evaluation that was then used to create a
false history of violence using me as the source. Again please read #1 in its entirety.
As a result of this and other lies I was taken from the safety of my home and the father who had raised me from
infancy and sent to live with alcoholics and drug addicts who exploited me, forced me to work and took the money
for drugs, isolated me from my father, and sexually assaulted me. When I suffered a nervous breakdown in March
of 2009 and drove away from my life at UCLA to live on the streets homeless and starving, my father was the only
one to look for me. While he had hired a private investigator to try and find me, my mother and stepmother were
claiming that I was doing fine and still in school. When I collapsed and ended up in a critical care unit in Santa
Monica CA he flew down and spent the first month in CCU with me night and day. During my two months in a
nursing home he visited me for four weeks and he spent the entire two months with me in neuro-rehab taking over
my care when I was still a quadriplegic. During the six months I was hospitalized, my mother only made the two
hour trip four times and never stayed for more than two hours, I have not heard from her since October 2009. I
work seven days a week 365 days a year to rehabilitate myself physically and emotionally from the illness and the
events that led to my nervous breakdown, and by continuing to deny me the truth you put my success at risk.
As a result of previous meetings, your supervisor is aware that I and my father have made numerous unofficial
written requests for this information that have been ignored and/or rebuffed. As the original FOIA request was
made in November I would ask again that this be addressed in writing without further delay. I am providing an
additional signature line for my father to make it clear that we are acting as a family and that the FOIA request
can be addressed as a family request.

relate to two separate issues. First, why was I not placed with either my grandparents or our close friends the Wards
who had two daughters my age in their home? Secondly is the statement by Ms Brookbank that “Mr. Bare’s daughter
